This Privacy Policy provides you with information on how Mahindra & Mahindra Limited, Gateway Building, Apollo Bunder, Mumbai 400 001, Maharashtra, India (“we” “us” “our”) processes your personal data for the purpose of registering and using the features and services offered by us through our Tractor Connectivity Software Application called MyOJA (“App”) which is available to you in four regional languages for the purpose of establishing connectivity between your Mahindra Oja tractor and your mobile device and how you can exercise your privacy rights.

The App allows all Mahindra Oja tractor customers to leverage the technology packed features and access all basic information about their tractor. By using this App, customers can monitor their tractor’s location and performance remotely, and get critical alerts. The App also provides Oja customers with their tractor information, enables them to locate nearby dealers, and book a service. The App, in short, provides a simple interface for customers to easily leverage the intelligent telematics in their Mahindra Oja tractor.

Before using this App, you should review the Privacy Policy and the Terms of Use. By using this App, you are consenting to the processing of your personal data as set forth in this Privacy Policy. You are under no obligation to provide the personal data that we ask you for. However, if you do not provide your personal data, you will not be able to make use of all the functionalities, connectivity features and services offered on this application.

1. Personal data that we collect:

We collect your personal data directly from you during the Know Your Customer (KYC) process (viz., name and mobile number) when you provide us with it at the time of completing the KYC form at our authorised dealerships.

During your visit of this App, we will automatically collect the following information:

  • name and version of your web browser.
  • certain cookies (see point 2 below).

We may use a third-party service provider to assist us with some features of our App. Our service provider will receive your personal data on our behalf and will not be permitted to use it for any other purpose. We do not sell your personal data to anyone.

Where we receive personal data from you directly, then you will be responsible for ensuring that such data is given to us in compliance with applicable data protection laws.

3. Purposes for which we process your personal data.

The use of your personal data is subject to the privacy policy in effect at the time of our use. We will process your personal data for the following purposes:

  • to help us to identify you when you login to the App with your name and mobile number.
  • to make this software application and all its functionalities, features and services available to you and to further optimize and develop them.
  • to provide you with location-based services on the App.

  • to use or disclose the data collected from the tractor’s telematics control unit for improvement of offered services and other personalization features.
  • to create usage statistics of this App.
  • to be able to recognize, prevent and investigate attacks on the App.
  • to communicate with you.
  • to provide and process service requests initiated by you.
  • to provide you with relevant information regarding our products and services through your mobile phone.
  • to comply with legal and contractual obligations.

We endeavour to collect only such information that is reasonably necessary to perform the services for you or to respond to your queries.

4. Legal basis of the processing

We can only use your personal data if we have a legal basis for doing so. We process your personal data provided by you either (i) on the basis of our prevailing legitimate interest to achieve the purposes set out above; or (ii) on the basis of the necessity for the performance of the contract we have concluded with you or to take steps at your request prior to entering into such an agreement; or (iii) on the basis of the necessity to comply with legal obligations to which we are subject. If we process your data based on your consent, we will ask for your consent in a separate process.

5. Transfer of your personal data:

We share or disclose your personal data only when necessary to provide our services or conduct our business operations.

As far as this is necessary for the purpose set out above, we will transfer your personal data to the following recipients:

  • Service provider(s) that we may use to support us on the functionalities of the App.
  • Public authorities (which includes government agencies, law enforcement and other public authorities)

We only transfer your personal data to recipients that have an adequate level of data protection by implementing appropriate technical and organizational security measures, or we take measures to ensure that all recipients provide an adequate level of data protection as prescribed by applicable law.

6. How long do we keep your personal data

We will retain your personal data for as long as we reasonably consider it necessary for achieving the purposes set out under Point 3 above and as is permissible under applicable law. We will, in any case, retain your personal data for as long as there are statutory retention obligations or potential legal claims are not yet time barred.

7. Security of Personal Data

We are strongly committed to protecting your privacy and the security of your personal data. Accordingly, we implement reasonable security practices and procedures in relation to the personal data and other information that is processed by us.

8. Your rights in connection with your personal data

We respect your right to access and control your information, and we will respond to requests for information and, where applicable, will correct, amend, or delete your personal data.

In such cases, we will need you to respond with proof of your identity before you can exercise these rights. Please note that applicable law might require that we cannot comply with every request. We will be required to keep your personal data due to statutory retention requirements despite your request for erasure.

Under applicable law, you have, among others, the rights (under the conditions set out in applicable law): (i) to check whether and what kind of personal data we hold about you and to request copies of such data, (ii) to request the correction, completion, updation, or erasure of your personal data that is inaccurate or processed in non-compliance with applicable requirements, (iii) to request us to restrict the processing of your personal data, (iv) in certain circumstances, to object for legitimate reasons to the processing of your personal data or to revoke consent previously granted for the processing where such revocation does not affect the lawfulness of the processing until the revocation, (v) to know the identities of third parties to which your personal data are transferred, (vi) to lodge a complaint with the competent authority for grievance redressal, and (vii) to nominate any individual who shall in the event of death or physical or mental incapacity exercise your rights in accordance with applicable data protection laws.

We may update this Privacy Policy from time to time. Any material changes to the Privacy Policy will be posted on this page. The updated Privacy Policy will take effect as soon as it has been updated.
